Right of withdrawal
The right of withdrawal is reserved exclusively for consumers (natural persons who acquire goods for purposes not related to their professional, commercial or entrepreneurial activity), and cannot be exercised by legal persons or by natural persons who act for purposes referable to the professional activity that may be carried out.
The costs of returning the product are borne by the customer.
In the event of damage to the good during transport, modemore will inform the customer of the incident (within 14 working days from receipt of the asset in his warehouses), to allow him to promptly file a complaint against the chosen courier and obtain the reimbursement of the value of the property (if insured); In this eventuality, the product will be made available to the customer for the return, simultaneously canceling the request for withdrawal.
The return costs, the means and the shipping methods are charged and under the responsibility of the customer himself, who will not be compensated by modemor in the event that the goods were lost, damaged, stolen or lost.
In the event of withdrawal from the purchase contract of electronic devices, the user must independently restore the factory configurations of the article (e.g. eliminating personal account and/or passwords). Otherwise, the product will be considered damaged and modemore will not proceed with the refund.
To benefit from the right of withdrawal, it is necessary to return goods to the integral and/or sealed packaging, not tampered with, not expired and not consumed, not even partially. The return is not allowed in the following cases:
a) purchase of medical devices;
b) supply of food, drinks or other goods intended for current consumption, provided by a professional with frequent and regular deliveries at home, residence or workplace of the consumer;
c) purchases lower than 50 euros, unless the total consideration due to exceed this amount;
d) service contract after complete provision of the service, if the execution began with the consent of the consumer;
e) supply of tailor -made or clearly customized assets;
f) supply of goods that risk deteriorating or expires quickly;
g) supply of sealed goods that cannot be returned for hygiene or health protection reasons and which have been opened after delivery;
h) supply of goods which, by their nature, are inseparably mixed with other goods after delivery;
i) vouchers, gift cards and similar products (e.g. gift boxes, gift cards, fuel vouchers, virtual recharges);
j) prepaid cards and/or telephone top -ups activated by the customer.
They are not accepted rendered for non -sealed articles, unless they present a malfunction.
** Methods and times for the exercise of the right of withdrawal **
The maximum time to submit requests or complaints are as follows:
- 14 days for complaints relating to defective goods, missing or not compliant with the order.
- 30 days for withdrawal on clothing items.
- 14 days for requests regarding shipments or deliveries (e.g. package not received, stock, delivery problems).
- 14 days for requests regarding payment or reimbursement transactions.
The customer has a period of 14 (fourteen) days to withdraw from the contract. This period starts from the receipt of the goods or, in the event of services, from the conclusion of the contract. Within this term, the customer must communicate the will to withdraw from the contract to modemore.
The customer's rights are protected by Legislative Decree 206/2005. The Customer can therefore withdraw from the contract, even partially, without explanations and without additional costs, provided that sending communication by registered letter with return receipt to Mitrovo S.r.l within 14 working days of receiving the products. The communication can be anticipated by email to info@modemore.it, provided that it is confirmed by registered letter with return receipt within 48 hours. In the communication, the product or products for which the right of withdrawal is exercised must be specified, attaching a copy of the receipt. The customer must then return the products at his expense, sending them to:

The reimbursement of the entire amount will be carried out within 14 days from the acceptance of the return. The shipping costs for the initial sending will remain on the customer and amount to € 15.00 per package. In the event that the package is returned by unknown address, an absent or refused recipient without justification, the expenses will amount to € 30.00 per package.
If the right of withdrawal is exercised for a product damaged by email or registered letter, with the return of the same (according to the indications provided), the reimbursement procedure will be as follows:
Pursuant to article 56 of Legislative Decree 206/05, Modemore.it will reimburse all payments within 14 (fourteen) days from the reception of withdrawal from the customer.
Modemore.it may hold back the refund until it receives the intact product or until the customer proves to have sent it back, depending on the situation that occurs first.
For purchases made by credit card, the reimbursement will be performed via the Storno of the transaction on the credit card. For purchases with good, the customer will receive the restoration of the vouchers.
